			<content:encoded><![CDATA[<p>Specific cases of fraud are my favorite blog articles.  A CPA in Houston Texas has been barred from practice before the IRS.  The IRS and Karen Hawkins have disclosed the suspension of Robert Loeser.  Mr. Loeser has been suspended from practice before the IRS for 12 months.</p>
<p>His scheme went something like this, set up some shell corporations.  His clients would then write these companies checks, for fake expenses.  The shell company would then reimburse the client.  How does this become a deduction?  Shouldn’t the shell company have income?  But then the shell company’s reimbursement would create income for the client, offsetting any expenses.  This is a criminal enterprise, if I have ever seen one.</p>
<p>Why isn’t this CPA, Robert Loeser, in prison?  Shame on the Office of Professional Responsibility, this CPA belongs in prison.  I do not know if criminal prosecution is within the power of the Office of Professional Responsibility, but why isn’t this CPA in prison?</p>
<p>This man set up a scheme to defraud the government.  Texas should revoke his CPA, and the US Government should put him in prison for several years.</p>

			<content:encoded><![CDATA[<p>Every community has their share, preparers that just violate the law.  I have seen 3 in my community, in the last few years.  The devastation these people create is phenomenal.</p>
<p>Fraudulent preparers leave victims in doubt for years.  The IRS must stop these preparers quicker.  These preparers that are filing fraudulent returns are the reasons for the increased scrutiny of the industry.  Fraudulent preparers are the driving force behind the licensing and testing of preparers.  If you have to have a license to cut hair, why don’t you need a license to prepare income tax returns?</p>
<p>Furthermore, the article from US News and World Report, written by Alex Kingsbury, cites some fantastic statistics.  In 2001 the government prosecuted, 1 preparer, since 2001 the government has prosecuted 435 preparers.  That represents 62 prosecutions annually, since 2001.</p>
<p>Is anybody doing their job?  I cannot believe that the government could only find 62 preparers to prosecute, remember I have seen 3 fraudulent preparers in my community.  None of the preparers have been prosecuted.</p>
<p>My firm offers all of the products of a chain preparer; however, we have a year round office and highly trained staff members.  The biggest difference between my firm and a chain preparer, we are open and honest about our fees.  I take my fair share of clients from the chain preparers.  Those clients that come from the chain preparers, they have no idea what they paid in fees to prepare their tax returns.</p>

<p>This firm works with outside counsel across the country.  We represent clients in 18 states and 3 countries.  We have consulted with lawyers and law firms from across the country.  We have found that a team of professionals, CPAs and lawyers, can achieve fantastic results for their clients.</p>
<blockquote><p>It is surprising just how many people try to escape their duty to pay tax to the federal government each year. Anyone found doing this is committing an offence under the tax laws of the United States. Each person and business has a duty to pay taxes to their government so it is able to function properly and fulfil its duty to its citizens. Normally, when this type of crime is committed, it is by people that have no previous record with the police or authorities.</p></blockquote>
<blockquote><p>Tax fraud is a general term used to refer to offences such as tax evasion, non-filing of tax returns, forgery, non-declaration of assets and income, misrepresentation of conditions for the purpose of tax exemption and other such actions related to the payment of taxes. Tax fraud lawyers are specialized attorneys that deal with issues of tax fraud and represent clients who are accused of tax fraud.</p></blockquote>
<blockquote><p>Unlike other kinds of tax lawyers, tax fraud lawyers do not advise on tax planning or filing of income tax returns. If you require their services then either the worst is about to happen and you suspect the IRS are investigating you or they have concluded their work and have charged you with tax fraud offences. On many occasions, a tax fraud lawyer is used merely as a negotiating tool to lessen the chances of a prison sentence and to find ways that outstanding tax debts can be paid.</p></blockquote>
<blockquote><p>It is not uncommon for people and even companies to fail in their tax responsibilities through lack of knowledge or understanding of their responsibilities. Some individuals and firms also fall foul of poor advice for their tax planning form the tax specialists they employ to represent them.</p></blockquote>
<blockquote><p>If an attorney proves that his client is the innocent victim of wrong tax advice by some tax consultants, it’s likely that the charges against them might get dropped or a lenient sentence might be passed. The need to choose a tax consultant that has proper qualifications cannot be underestimated in circumstance like this if investigation by the IRS is too be avoided.</p></blockquote>
<blockquote><p>Although it would be normal for a custodial sentence to be passed the purpose of the tax fraud lawyer is to try and stop this from happening by negotiating with the authorities to allow the tax evader to escape imprisonment so they will be able to repay their tax debt. Often this line of reasoning works if presented by a good lawyer as it means that the offender will still pay any tax that is owed without the financial burden of paying for them to be in prison.</p></blockquote>
<p>Most taxpayers do not need legal counsel; however, if you need legal counsel, you probably need a new CPA as well.  You need to hire a CPA that has both a technical knowledge of the Internal Revenue Code as well as abundant practice before both the exam and collection divisions of the Internal Revenue Service.</p>

<p>I do not represent tax protestors.  There is money to be made from a taxpayer that does not think he or she should have to pay income taxes, but that is not the type of client that I represent.  I represent people who have run afoul of the taxing authorities, but they do not disagree with the taxation.</p>
<p>Most of my clients would like to negotiate away the penalties.  Most taxpayers agree with paying the base tax, but they think the government is being unfair to assess penalties and interest.  I disagree, the penalties for failure to file and failure to pay, should start at 50% each.  If the government is assessing penalties, the penalties should be a deterrent.</p>
<p>All forms of penalties and interest should be transparently disclosed to the taxpayer.  If you open a new Employer Identification number, you should get a disclosure that explains penalties and interest.  The taxing authority should disclose to the taxpayer, this is serious and could ruin you financially forever.</p>
<p>That said, I represent my client to the fullest extent of the law.  Everybody has the right to representation, even a tax protestor.  Just because I don’t agree with the protestor, doesn’t mean I won’t represent them to the fullest extent of the law.</p>

			<content:encoded><![CDATA[<p>Most state governments have seen voluntary compliance plummet.  New York has figured that out, New York has taken a massive step in the right direction.  New York’s prosecution of non filing taxpayers has gone up 360%.  That statement is made by the acting Commissioner Woodward.</p>
<p>Note the title of the article New York is prosecuting lawyers, doctors and accountants.  New York is employing new technology and investigating non filers.  New York has upped its enforcement, and has targeted non filers.</p>
<p>Non filers belong in jail that is the opinion of Commissioner Woodward.  That is not the opinion of a practitioner who represents the taxpayers of New York.  To help its tax payers, New York has set up a voluntary compliance program.  New York is giving you a way out.  If you have not filed your tax returns in several years, hire a professional and participate in the voluntary compliance program.</p>

			<content:encoded><![CDATA[<p>From the timesnews.net, a Tennessee man was charged with tax evasion.  It would seem that Kevin Lee Hubbs did not remit the sales tax that he collected.  He has been charged with 12 felony counts, this is serious, and for allegedly not remitting $13,000.</p>
<p>This is good work by the State of Tennessee.  Every state in the Union should be on the lookout for sales tax cheats.  If a business owner collects, but does not remit any taxes collected, this creates a situation where one person has a competitive edge over the competition.</p>
<p>There is no application, and you cannot be denied.  If you don’t want to remit taxes that you have collected for the state, just don’t remit the tax owed.  The state should do a better job of incarcerating offenders, enforce the law.</p>
<p>I do not think any business should be allowed a competitive advantage, just because they do not remit the taxes owed.  This gentleman is looking at time in prison and a hefty fine.</p>

			<content:encoded><![CDATA[<p>I read a very interesting article the other day.  The article was written by someone claiming to be a Certified Public Accountant in New York.  His idea in a nutshell:</p>
<p>If you are a small business with employees, here is how to structure your employment compensation.  If you would have paid $50,000 salary per year, the employee would be responsible for $12,500 in federal income taxes.  The idea the CPA has come up with is, pay the employee $12,500 less per year, but pay the employee’s federal income tax bill.</p>
<p>He proposes this as a legal way around the Social Security and Medicare taxes.  If the employer reduces the employee’s gross wages you will reduce Social Security and Medicare taxes.  The employee saves money, the employer saves money, and everybody wins but the government.  I have some problems with this idea:</p>
<ul>
<li>The employee is receiving an economic benefit.  They have received additional compensation, the payment of the tax liability, must be considered compensation.  If the employee receives compensation, why shouldn’t the employer, withhold Social Security and Medicare taxes?  Furthermore, shouldn’t the employer match the Social Security and Medicare taxes?</li>
<li>How is the employer going to report the additional compensation?  On Form 1099?</li>
<li>What about retirement plans?  Most employer matching is based on gross wages.  If the employer and employee reduce the gross wages, the employer would not match as much as they should have.  It is my experience, if you short an employee something they deserve, the employer will always lose.</li>
<li>If the IRS examines the employer’s books and records, and discovers this compensation methodology, the employer will owe both sides of the Social Security and Medicare taxes.  The taxes (both sides), penalties and interest, would be severe and costly.</li>
</ul>

			<content:encoded><![CDATA[<p>Jackson Hewitt is having issues with their RAL (Refund Anticipation Loan) bank.  It seems that their RAL bank is not solvent and the regulators shut the bank down. </p>
<p>Are you kidding me? This is exactly why you should not use a national firm to have your income tax returns prepared.  I represent people from all over the country.  There are plenty of great preparers.  Here are some things to look for in a preparer:</p>
<ol>
<li>Pay your preparer.  Do not have your uncle, or a friend or some other person prepare your tax return.  Who doesn’t want pay for great services?</li>
<li>Look for initials.  Your preparer should have a designation, attorney, CPA, EA.  When you have a heart attack, you don’t go to the dentist.  Why would you let someone prepare your return without specific credentials and experience?</li>
<li>Is your preparer in their office 12 months a year?  If the taxing authority has a problem with your return, you will probably receive a notice in the mail.  Don’t you want your preparer to be in the office when that notice arrives?</li>
<li>Has your preparer got the experience level you are looking for?  Continuing Professional Education is required at this firm.  We do not let anyone prepare a tax return unless they are trained, educated and experienced.</li>
</ol>
<p>What happens when you choose the wrong preparer?</p>
<ol>
<li>You spend 3 or more years worried about the IRS and other taxing authorities.</li>
<li>You might pay heavy penalties and interest.</li>
<li>You could be charged with a crime.</li>
</ol>
<p>The tax law is extremely complex.  Take a moment, choose a good honest preparer.  If you are not sure about the preparer you have, call my office 877-489-8999.  Spend a few minutes on the phone with one of us, and you might just hire us.</p>

			<content:encoded><![CDATA[<p>I am happy to see that the world’s largest tax resolution firm has altered it delivery of services.  For years my firm has criticized them for the way the practice and handle cases.</p>
<p>Tax Matters Solutions, LLC has always given away a resolution strategy.  You cannot resolve an IRS problem until the taxpayer is compliant.  You cannot resolve a tax problem until you know the base tax owed, you cannot know the base tax unless the taxpayer is compliant.</p>
<p>We call this service the setup fee.  The setup fee covers Tax Matters Solutions’ time to find out what is filed/unfiled, and what it is that the taxpayer needs to do.  I tell all potential clients, “It doesn’t matter what you and I think, what matters is what the government thinks.”  You have to find out what needs done, in order to quote a fee to resolve the entire case.</p>
<p>Once we know what needs done, the client is then quoted a fee for services, some clients get a flat fee other clients pay hourly.  Hourly clients are billed every two weeks.  We are upfront and honest about fees, no client has ever been extorted for a fee.</p>
<p>My advice, hire me, forget the national firms.  The national firms have too many layers of overhead.  Their fees will be higher than mine, and their performance will not be as good.</p>

<p>Anthony Wayne Hoosier Patriots’ distinguished panel of disgusted citizens will query Mr. Stutzman, a bright young Conservative with an old man’s name.  An Indiana state legislator since 2003, Mr. Stutzman is currently running against three other candidates for the opportunity to challenge Evan Bayh in the November election.  Our panel’s intent is to determine if Marlin has the energy, knowledge, experience and ideas to challenge an incumbent with over twelve million dollars in his war chest.  In today’s turbulent political environment, is Mr. Stutzman, a fourth-generation Hoosier farmer, our man?   </p>
